This Regulatory Statement (RS) is valid until 1 February 2027 by which time it will be reviewed. You should check back at that time to ensure the RD is still valid.
Natural Resources Wales (NRW) can withdraw or amend this RS before the review date if we consider it necessary. This includes where the activities that this RS relates to have not changed.
Regulatory statement
This RS does not change your legal requirement to:
- Register, if required, as a large producer in line with the Producer Responsibility Obligations (Packaging and Packaging Waste) Regulations 2024 (the Regulations).
- Report packaging data in line with the Regulations.
- Make all reasonable attempts to meet your recycling obligations.
However, NRW will not take enforcement action against you if you do not comply with your 2026 recycling obligations set out in Schedule 5 of the Regulations, if you meet the conditions set out in this RS.
Conditions you must comply with
Your statutory recycling obligations for the 2026 compliance year are set out in Schedule 5 of the Regulations.
You must achieve your full statutory recycling obligations, for aluminium, paper and glass.
For plastic, steel and wood you must achieve a minimum of;
- 83% of your statutory recycling obligation for plastic
- 92% of your statutory recycling obligation for steel
- 90% of your statutory recycling obligation for wood
Keep records for 5 years to show that you have complied with this RS and make these records available to NRW on request.
Enforcement
This RS does not change or remove any of your legal obligations under the Producer Responsibility Obligations (Packaging and Packaging Waste) Regulations 2024.
However, NRW will not normally take enforcement action if you comply with the specific legal requirements set out in this RS.
