Regulatory Decision 019: The disposal of infected straw, manure and litter by incineration or co-incineration during an outbreak of a notifiable animal disease

This Regulatory Decision is valid until December 2024 by which time it will be reviewed. You should check back at that time to ensure the Regulatory Decision is still valid.

NRW can withdraw or amend this regulatory decision before the review date if we consider it necessary. This includes where the activity that this RD relates to have not changed.

Regulatory Decision

Infected straw, manure and litter are hazardous wastes. The hazard and waste code is HP9 (infectious) 18 02 02* - wastes with special requirements for collection and disposal to prevent infection.

This regulatory decision (RD) is allows the incinerating or co-incinerating infected straw, manure and litter from an animal disease outbreak identified by APHA without adding waste code 18 02 02* to the permit conditions.

Conditions you must comply with 

You must:

  • only incinerate the waste in a compliant plant (that is designed to accept this waste)
  • only incinerate straw, manure and litter identified by APHA as infected or potentially infected from an animal disease outbreak
  • only incinerate infected waste moved under a licence issued by APHA and a hazardous waste consignment note
  • submit a risk assessment Natural Resources Wales that shows you have systems in place for receiving, storing and handling waste and feeding it into the incinerator, to prevent the release of infectious material
  • not exceed the emission limits in your permit
  • get agreement from Natural Resources Wales by email that you can incinerate or co-incinerate waste before you move it from the place it was produced

Enforcement

This RD does not change your legal requirement to comply with an environmental permit to incinerate or co-incinerate waste when you accept infected straw, manure and litter.

However, NRW will not normally take enforcement action if you do not comply with an environmental permit for accepting Infected straw, manure and litter 18-02-02* if you meet the requirements in this RD.

Your activity must not cause (or be likely to cause) pollution of the environment or harm to human health, and must not:

  • cause a risk to water, air, soil, plants or animals
  • cause a nuisance through noise or odours
  • adversely affect the countryside or places of special interest
