Regulatory Decision 076: Acceptance of portaloo/chemical toilet waste at wastewater treatment plants

This Regulatory Decision is valid until 1 June 2025 by which time it will be reviewed. You should check back at that time to ensure the Regulatory Decision is still valid.

NRW can withdraw or amend this regulatory decision before the review date if we consider it necessary. This includes where the activity that this RD relates to has not changed.

Regulatory Decision

This regulatory decision allows acceptance of non-hazardous portable toilet wastes (Waste code 16 10 02) at a wastewater treatment works operated by a Water Company where the appropriate permit is not in place.

Store portable toilet wastes at a wastewater treatment works pending discharge into the wastewater treatment process.

Conditions you must comply with 

You must:

  • use the waste classification technical guidance (WM3) to classify this waste as hazardous or non-hazardous (16 10 01*/16 10 02)
  • only receive portable toilet wastes bearing the correct EWC code and description which are accompanied by an appropriate risk assessment
  • ensure all areas used for the reception of portable toilet wastes have an impermeable surface with sealed drainage
  • All waste contractors are inducted and have a datalogger key for the WWTWs
  • Duty of Care Waste Transfer notes are provided
  • All waste contractors are Upper Tier Registered Waste Carriers
  • No hazardous waste is accepted
  • Not accept portable toilet wastes mixed with other wastes

Enforcement

This RD does not change your legal requirement to have an environmental permit for a waste operation. When you are accepting portaloo/chemical toilet waste into the head of works of a waste water treatment works.

However, NRW will not normally take enforcement action if you do not comply with the need for an environmental permit if you meet the requirements in this RD.

In addition your activity must not cause (or be likely to cause) pollution of the environment or harm to human health, and must not:

  • cause a risk to water, air, soil, plants or animals
  • cause a nuisance through noise or odours
  • adversely affect the countryside or places of special interest
