Regulation 6 (2) of The Countryside Access (Exclusion or Restriction of Access) (Wales) Regulations 2003 requires NRW as a relevant authority to publish a draft direction on a web site when it is minded to approve an exclusion or restriction of access for the avoidance of the risk of fire or danger to the public under section 25(1) of the Countryside and Rights of Way Act 2000.
This requirement relates to potential exclusions or restrictions of public access “indefinitely or during a period which exceeds, or may exceed, 6 months” [Reg 6 (1)].Regulation 6 (2) and 6 (3) requires NRW to send a copy of the draft direction and its assessment report for comment to each of the organisations listed in Schedule 1 and to the relevant local access forum.
Regulation 8 requires that NRW consider before deciding whether to give a direction, any representations made by the above persons within the time permitted and NRW may, if it thinks it appropriate consider any other representations which it receives.
Reason for excluding or restricting the right of access
Provision of the Countryside & Rights of Way Act 2000 under which the draft direction is given:
Section 25(1)(b) - Avoidance of danger to the public.
